Terms of Service

By accessing or using the KauaiVacation.us website platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all guests, hosts, and visitors.
2. Platform Role
Kaha Lani 304 provides an online marketplace connecting property hosts with guests seeking vacation rentals. We are not a party to any rental agreement between hosts and guests. All rental arrangements, obligations, and disputes are solely between the host and guest.
3. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use the Service. By using the platform, you represent and warrant that you meet these requirements.
4. User Accounts
* You must create an account to access certain features.
* You agree to provide accurate, current information.
* You are responsible for maintaining the confidentiality of your login credentials.
* You are responsible for all activity under your account.
5. Host Responsibilities
Hosts agree to:
* Provide accurate listing information, including pricing, availability, and property details.
* Maintain safe, clean, and lawful accommodations.
* Honor confirmed bookings.
* Comply with all applicable laws, regulations, and local ordinances.
* Manage communication and expectations with guests.
6. Guest Responsibilities
Guests agree to:
* Provide accurate booking information.
* Respect host property, rules, and local laws.
* Pay all fees associated with bookings.
* Report damages or issues promptly.
7. Bookings & Payments
* All bookings are considered confirmed once payment is processed.
* Payment processing is handled through third‑party providers.
* You authorize us to charge your payment method for all applicable fees, taxes, and charges.
* Hosts receive payouts according to our payment schedule.
8. Cancellations & Refunds
Cancellation policies are set by hosts and displayed on each listing.
* Guests must review the cancellation policy before booking.
* Refunds are issued according to the host’s policy.
* Service fees may be non‑refundable.
9. Prohibited Activities
Users may not:
* Use the Service for unlawful purposes.
* Provide false or misleading information.
* Damage, disrupt, or interfere with the platform.
* Attempt to circumvent fees or payment systems.
* Engage in harassment, discrimination, or abusive behavior.
10. Content Ownership & License
Users retain ownership of content they upload (photos, descriptions, etc.). By uploading content, you grant Kaha Lani 304 a non-exclusive, royalty-free license to use, display, and distribute that content for platform operation and promotion.
11. Privacy
Your use of the Service is also governed by our Privacy Policy. We take reasonable measures to protect your information but cannot guarantee absolute security.
12. Limitation of Liability
To the fullest extent permitted by law:
* Kaha Lani 304 is not liable for damages arising from host–guest interactions, property conditions, or booking disputes.
* We are not responsible for loss of data, revenue, or business opportunities.
* Your sole remedy for dissatisfaction with the Service is to stop using it.
13. Indemnification
You agree to indemnify and hold harmless Kaha Lani 304, its employees, and partners from claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
14. Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration in the jurisdiction where the company is headquartered, unless prohibited by law.
